This policy describes how we collect, use, store, and protect your personal information in accordance with Law No. 19,628 on Protection of Private Life and current regulations in the Republic of Chile.
1. Information We Collect
We collect information that you provide directly when using our platform, including: full name, email address, phone number, personal identification data (RUT), financial information necessary for investment operations, IP address and browsing data, and information provided through contact forms. Additionally, we automatically collect technical data from your device and browser to ensure security and optimize the user experience.
2. Use of Information
We use your personal information for the following purposes: to facilitate access to and use of our real estate crowdlending platform, to process and manage your investments in real estate projects, to verify your identity in accordance with anti-money laundering regulations (Law No. 19,913), to communicate updates about projects you participate in, to send you relevant information about new investment opportunities (with your prior consent), to comply with legal and regulatory obligations before the CMF and the SII, and to improve our services and user experience.
3. Legal Basis for Processing
The processing of your personal data is based on: express consent granted upon registration on the platform, execution of the investment contract entered into between the parties, compliance with legal obligations (Law No. 19,628, Law No. 19,913, CMF regulations), and Assetoraa's legitimate interest in improving and securing its services.
4. Data Sharing
We do not sell or rent your personal information to third parties. We may share your data with: real estate developers associated with projects in which you invest (limited and necessary information), technology service providers who assist us in operating the platform (under confidentiality agreements), regulatory entities and competent authorities when required by law, and legal and accounting advisors for compliance with tax and regulatory obligations.
5. Data Security
We implement technical and organizational security measures to protect your personal information, including encryption of data in transit and at rest using TLS 1.3 protocols, role-based access control, continuous monitoring of suspicious activities, encrypted backups with geographic redundancy, and periodic security audits conducted by independent third parties.
6. Your Rights
Under current Chilean legislation, you have the right to: access your stored personal data, rectify inaccurate or outdated data, request the deletion of your data (subject to legal retention obligations), object to the processing of your data for direct marketing purposes, and request the portability of your data in a structured format. 7. Data Retention
We retain your personal data for as long as you maintain an active account on our platform and, subsequently, for the periods required by Chilean law. Financial and tax records are kept for a minimum of 6 years under the Tax Code. Identification data is maintained in accordance with anti-money laundering regulations.
8. International Transfers
In the event of transferring personal data outside Chile, we ensure that such transfers are carried out with appropriate safeguards, including standard contractual clauses and verification of the recipient country's level of protection.
